World's Fair Capital, Private Investment Firm

Alaska lends itself to a deed of trust structure. The statute lets a trustee sell under a deed of trust without a court decree once notice is recorded at least 90 days before the sale, and it bars further action for a deficiency after a trustee sale. Construction lien claims must generally be recorded within 120 days of completion or the last furnishing, which matters for draw schedules, and the state's geological survey points to earthquake and tsunami exposure along the coast.

World's Fair Capital makes business purpose loans to real estate investors in Alaska: fix and flip, DSCR rental, bridge and ground-up construction. This page covers points that most often matter to an investor there, each checked against the statute or agency that publishes it. It is general information, not legal or tax advice, and terms for any loan are set at underwriting.

What investors should know about Alaska

Trustee sale notice timing

Alaska allows a trustee to sell property under a deed of trust without first obtaining a court decree, if the statutory notice steps are followed. The notice of default must be recorded at least 30 days after the default and at least 90 days before the sale.

Deed of trust is the security instrument

Alaska's statute describes a deed of trust that conveys real property to a trustee as security for an indebtedness. The deed can provide that the trustee may sell the property if the terms of the trust are broken.

Mechanic's lien filing window

When an owner has not recorded a notice of completion, a claim of lien must be recorded within 120 days after the claimant completes the contract or stops furnishing labor, materials, services or equipment. This timing matters when a project is funded in draws.

Earthquake and tsunami exposure

The Alaska Division of Geological and Geophysical Surveys notes that many coastal communities sit above the Alaska-Aleutian Megathrust, and that large earthquakes can bring tsunami and landslide risk.
