Power of sale is available in a mortgage

Oklahoma's Power of Sale Mortgage Foreclosure Act lets a mortgage grant a power of sale. The statute requires the mortgage to say in bold, underlined language that the lender may sell without a court foreclosure action.

Under the statute, the notice of sale must be personally served, with a stated alternative when personal service cannot be made, at least thirty days before the sale date.

Mortgage tax scales with loan term

Oklahoma levies a tax on real estate mortgages at a rate set by the term of the mortgage, from ten cents per $100 for five years or more down to two cents per $100 for terms under two years. The county treasurer also collects a $10 certification fee per mortgage. The statute allows the mortgagor, mortgagee or another interested party to pay.
