Colorado uses the deed of trust and the public trustee. The statute sets a first sale date between 110 and 125 calendar days after the notice of election and demand is recorded for non-agricultural property, and it provides a redemption process for qualifying junior lienors. Mechanic's lien claimants generally file within four months of their last work or materials after serving a notice of intent, which matters for draw schedules, and the state geological survey reports that about half of Colorado homes have radon levels of concern.

What investors should know about Colorado
Public trustee foreclosure on a deed of trust
In Colorado, a holder of an evidence of debt who declares a violation of a deed of trust covenant elects to sell by filing documents with the county public trustee. The statute lists the required filings, including a notice of election and demand and the original evidence of debt.

Sale timing for non-agricultural property
For a public trustee sale of property that is not agricultural, the initial sale date falls between 110 and 125 calendar days after the notice of election and demand is recorded. Agricultural property has a longer window.

Redemption by junior lienors
Colorado's redemption statute lets a qualifying junior lienor redeem after a foreclosure sale if listed requirements are met to the officer's satisfaction. Title vests after the redemption periods expire.

Mechanic's lien statement deadline
Colorado's lien statute requires a notice of intent to file a lien statement served at least ten days before filing. Most lien claimants must file within four months after their last labor or materials, with different rules for day or piece labor and some exceptions in the statute. These steps matter for draw-funded work.

Radon in Colorado homes
The Colorado Geological Survey says radon has been found in all parts of the state and that about half of Colorado homes have radon levels of concern. Testing is a common diligence item on rentals and flips.
