What investors should know about Texas
Non-judicial foreclosure
Texas foreclosures under a deed of trust use a power of sale, not a court case. The sale is a public auction held between 10 a.m. and 4 p.m. on the first Tuesday of a month, generally at the county courthouse, with at least 21 days' notice posted at the courthouse door, filed with the county clerk and mailed to each debtor by certified mail.

Security instrument
The security instrument in Texas is a deed of trust, which carries the power of sale that makes non-judicial foreclosure possible.

Title and closing
The Texas Department of Insurance sets the title insurance premium, and the premium covers the title search, examination and closing. Every title agent charges the same premium, but escrow fees and closing costs can vary from agent to agent.

Homestead protection
The Texas Constitution protects a family's or single adult's homestead from forced sale for most debts, with listed exceptions, and treats home equity credit separately. Our loans are business purpose loans on investment property, not loans against a borrower's homestead.

What counts as a business loan
The Texas Finance Code defines a commercial loan as one made primarily for business, commercial, investment, agricultural or similar purposes, and excludes loans made primarily for personal, family or household use. We make business purpose loans only.

Flood history
The National Hurricane Center's report on Hurricane Harvey in 2017 records more than 60 inches of rain over southeastern Texas and more than 300,000 structures flooded. The Texas Water Development Board's State Flood Plan combines 15 regional flood plans to map where flooding is a risk.

Expansive clay soil
Texas's state soil, Houston Black, is a highly expansive clay that shrinks and swells with moisture and commonly limits building-site development. Foundation condition is a standard diligence item on Texas rehab and construction deals.

The Texas Comptroller states that Texas has no state income tax. Investors should still confirm property, franchise and federal tax treatment with their own advisor.
