New Jersey's Construction Lien Law sets a 90 day window to lodge a lien claim after the last work, with 120 days for residential construction contracts, and gives priority to a mortgage recorded before a lien claim, to the extent of funds advanced or required to be advanced. For construction and rehab loans, draw timing matters. The Department of Community Affairs notes that the notice of intention to foreclose requirement applies to residential mortgage lenders. The state's hazard mitigation plan names flooding as the most frequent natural hazard in New Jersey.

What investors should know about New Jersey
Construction lien claim deadlines
Under the Construction Lien Law as amended by P.L.2010, c.119, a lien claim form must be lodged for record within 90 days after the last work or materials, except for residential construction contracts, which carry a 120 day window and a separate arbitration timing rule.

Residential construction lien window
For a residential construction contract the same statute allows 120 days from the last work, services, material or equipment.

Recorded mortgages and construction liens
The statute gives a mortgage recorded before a lien claim is filed priority over the lien to the extent funds were advanced or the mortgagee was obligated to advance them before filing, so draw timing matters.

Fair Foreclosure Act notice (residential)
The Department of Community Affairs states that the notice of intention to foreclose requirement applies to residential mortgage lenders and debtors. Business purpose investor loans are generally outside that residential framework, so confirm applicability with counsel.

Flooding is the most frequent hazard
The State of New Jersey Hazard Mitigation Plan, published by the Office of Emergency Management, identifies floods as the most frequent natural hazard in the state, which is why flood zone checks are routine on New Jersey properties.
