Trust deeds with power of sale

Nebraska law lets a trust deed carry a power of sale that a trustee may exercise after a breach. The beneficiary may instead choose to foreclose in the manner provided for mortgages.

Notice of default and sale mailing

Under the Nebraska Trust Deeds Act, a copy of the recorded notice of default is mailed within ten days of recording, and notice of the time and place of sale is mailed at least twenty days before the sale.

Nebraska imposes a documentary stamp tax on deeds. The rate is $3.32 per $1,000 of value for transfers before January 1, 2032, and $2.32 per $1,000 from that date.
