What investors should know about Virginia

Deed of trust is the security instrument

Virginia's Code treats a deed of trust to secure debts as a contract construed according to its terms, to the extent not in conflict with law, with default duties for the parties where the instrument is silent.

Notice before a trustee sale

Before a trustee sale the owner must be mailed a copy of the advertisement or equivalent notice by certified or registered mail, no less than 14 days before the sale for deeds of trust other than owner-occupied residential.

Advertising timeline for a trustee sale

Where the deed of trust sets the number of publications, the sale is held no earlier than eight days after the first advertisement and no more than 30 days after the last.

Virginia imposes a state recordation tax on deeds of trust or mortgages at 25 cents on every $100 or portion of the obligations secured, with special rules for open-end or unascertainable amounts.
